Easements by Estoppel Such easements are sometimes created by property owners’ conduct and are based on legal principles such as estoppel. They occur when a property owner intentionally causes another to rely on an impression of a right. If someone relies on those representations by spending time, money, or other resources, the courts may grant an easement to the party that relied on the promise, leading to easements by estoppel. Legal Implications Since easements have the power to significantly affect the property rights involved in property transactions, this is an issue that deserves careful consideration. Assessing the easements—be it through title searches or by hiring an expert—confirms certainty. Property owners are required to honor easement terms by maintaining access and refraining from obstruction and interference. Legal ramifications of violations include both court orders demanding compliance and reparations for loss or damage caused by unauthorized uses. Assignment and Termination The type of easement determines whether an easement passes with the property. Appurtenant easements transfer and bind future owners to current agreements. Gross easements are usually non-transferable; they run with the benefit of whoever was the original beneficiary. Termination mechanisms include mutual consent, termination condition takedown, and abandonment. Abandonment claims are typically well-founded based on unambiguous intent to let go of use.
