Debunking the “Sudden Emergency” Defense in Car Accidents

Every time we take to the roadways, we’re essentially taking our lives, and those of fellow motorists, into our own hands. We can’t control what other drivers do or plan for every possible eventuality. All we can do is keep the rules of the road in mind, drive with care, and always be aware of our surroundings.

Even then, you never know what types of unexpected situations might arise. From tires blowing out and people swerving into our lanes to giant potholes or deer seemingly appearing out of nowhere, we just have to think quickly and do the best we can to avoid danger. It’s because of those unpredictable developments that the sudden emergency doctrine was developed. If you’ve been injured in an accident and the at-fault driver is claiming sudden emergency, you may want to learn more about this defense and whether it’s legitimate. 

What Is the Sudden Emergency Defense?

In short, the sudden emergency doctrine is a legal argument used to defend drivers who claim they were faced with a sudden, unexpected situation that forced them to respond with little time to think about it. The principle behind it is that when a driver is confronted with danger through no fault of their own, they may not be held to the same laws and standards as someone who’s driving under normal conditions. As such, if their actions caused harm to someone else, they may not be held liable for the damages. 

What Is the Purpose of the Sudden Emergency Defense?

At first glance, the sudden emergency defense may seem a bit dubious. It may sound like an easy way for reckless drivers to avoid being held accountable for their actions. Rest assured, few things could be further from the truth. 

The sudden defense doctrine was developed to protect drivers who are unexpectedly forced to make difficult decisions. It’s a safeguard for situations in which there’s really no right move. For example, say you’re driving in the middle lane of a three-lane highway. You top a hill only to find a vehicle in your lane, going the wrong way, heading straight for you with no signs of changing course. 

What do you do? Do you veer to to the left and hit the semi-truck beside you or veer to the other side and hit the minivan on your right? Should you simply hit the brakes? That might result in you being sandwiched between the oncoming vehicle and the one behind you. None of those choices is going to have a positive outcome. Should you be held fully responsible for all the consequences of the action you take in that scenario? No, you shouldn’t, and that’s why the sudden emergency defense was created. 

Understanding When the Sudden Emergency Defense Doesn’t Work

Not all drivers who are at fault in accidents can use the sudden emergency defense. For it to be an option, the situation that led to the accident in question must have truly been sudden and unexpected. The driver can’t be the one who caused the emergency, either. At the same time, the driver must have reacted in what could be considered a reasonable manner. 

The sudden emergency doctrine doesn’t apply in instances where the driver who’s trying to use it caused or contributed to the emergency. It’s not a defense for distraction, carelessness, or recklessness. It doesn’t apply to those who cause accidents by overreacting to situations, such as swerving into another lane to avoid hitting a squirrel and instead hitting another vehicle. Additionally, the emergency in question must not be a problem that could have been planned for in advance, like bad weather. 

All Things Considered

No one can be prepared for everything that might go wrong on the road. Sometimes, we have to make snap decisions in situations that don’t seem to have a right answer. The sudden emergency defense was created with that in mind.  It doesn’t give careless drivers an easy way out, but it does protect drivers who respond reasonably to unexpected and unavoidable dangers.
