Landlords Responsible for Tenant Injury

When Are Landlords Responsible for Tenant Injury?

Posted on April 28, 2026 By Becky

Renting a home should provide a safe and comfortable place for tenants. However, when the property is poorly maintained or fails to meet basic living standards, it can put tenants at real risk.

In situations where harm occurs, tenants can even seek guidance and sometimes even compensation through personal injury solicitors who can help them understand their rights and options. While not every issue will lead to legal action, there are clear scenarios where landlords may be held responsible for injuries sustained within a rental property.

Exposure to Unsafe Materials

It makes no doubt that exposure to hazardous materials you didn’t know were there is one of the most serious risks a tenant could face. While this is a rare issue, some properties still contain asbestos or lead. Typically, these substances are found in older buildings and, if disturbed or deteriorating, they can pose significant health dangers. Long-term exposure is linked to serious issues, including respiratory and developmental problems.

Landlords have a duty to assess and manage these risks. This typically involves commissioning professional surveys before letting a property or carrying out renovations. If the survey identifies hazardous materials, appropriate steps need to be taken to either contain or remove them safely.

Untreated Mould Growth

Mould is another common issue that can quickly escalate. While the landlord is not necessarily responsible, when mould develops constantly, no matter the effort of the tenant, it is often a sign that there is a hidden issue with the property. It can develop in visible areas, such as around windows or ceilings, but it can also grow behind walls or under flooring, which makes it more difficult to spot.

The problem is that mould can have a serious impact on health, especially for children, seniors, and those with respiratory conditions. Landlords are responsible for addressing the root cause of mould when it isn’t linked to the tenant’s behaviour. As a general rule of thumb, problems are linked to invisible leaks, structural damp, or an inefficient ventilation system.

Injuries Caused by Lack of Repairs

Timely repairs are a fundamental part of a landlord’s obligations. When something breaks or becomes unsafe, it should be addressed within a reasonable timeframe. For instance, issues such as loose flooring, faulty stairs, or ven electrical hazards can lead to accidents if left unattended.

While it is the tenant’s responsibility to inform the landlord, and this is why you want to keep a trail of communication, it isn’t your responsibility to fix the problem. As a reminder, a tenant who failed to inform their landlord can’t claim for personal injury if the landlord was unaware that repairs were necessary.

Poor Insulation and Resulting Illness

Insulation may not seem like an immediate safety concern, but inadequate standards can have a direct impact on health. Poorly insulated properties are more prone to cold temperatures and damp conditions, both of which can contribute to a weakened immune system, respiratory conditions, and more.

In the UK, landlords are required to meet minimum energy efficiency standards, which means ineffective insulation should be flagged up quickly. However, properties that have been rented on an ongoing basis may not have been audited recently.

Ultimately, landlords have a legal and moral responsibility to provide properties that are safe to live in. However, it is important to appreciate that not every injury or illness occurring on the property is the responsibility of the landlord.

FAQs About Landlord Responsibility for Tenant Injury

When is a landlord legally responsible for a tenant injury?
A landlord is usually responsible when the injury is caused by poor maintenance, unsafe conditions, or failure to carry out necessary repairs after being informed.

What should I do if I’m injured in a rental property?
Seek medical attention first, then document the issue with photos and report it to your landlord in writing as soon as possible.

Do I need proof to make a claim against a landlord?
Yes, evidence such as photos, medical records, and communication with the landlord can help support your case.

Is a landlord responsible for mould-related health issues?
Only if the mould is caused by structural problems, leaks, or poor ventilation rather than tenant behaviour.

What if I didn’t report a repair issue before getting injured?
If the landlord was not aware of the issue, it may be harder to hold them responsible.

Are landlords responsible for accidents caused by other tenants?
Generally no, unless the accident is linked to a shared area that the landlord failed to maintain properly.

How quickly should a landlord fix safety issues?
Repairs should be carried out within a reasonable timeframe, especially if they pose a risk to health or safety.

Can I refuse to live in a property that feels unsafe?
You should raise concerns with your landlord first. If the issue is serious, you may need advice from a local authority or housing service.

What types of hazards are landlords most responsible for?
Common examples include faulty wiring, broken stairs, leaks, structural damage, and unsafe materials.

Do all injuries in a rental property qualify for compensation?
No, only injuries caused by landlord negligence or failure to meet legal responsibilities are likely to qualify.
